Omaha Police Release Update on Officer-Involved Shooting Investigation That Left One Man Dead

The Omaha Police Department has released additional information regarding the officer-involved shooting that occurred Saturday evening, stating that investigators have made significant progress as they continue to examine the circumstances surrounding the fatal encounter.

According to the department, the incident began when officers from the Omaha Police Uniform Patrol Bureau responded to a residence in the 1600 block of South 55th Street after receiving a 911 call requesting a welfare check on a reportedly suicidal individual. The caller expressed concern for the person’s well-being, prompting officers to respond to the home to assess the situation and provide assistance.

Police said officers, who were wearing official Omaha Police Department uniforms, arrived at the residence and attempted to make contact with the individual by knocking on the front door at approximately 5:50 p.m. Authorities stated that, about one minute later, the situation escalated dramatically.

According to investigators, a man inside the residence allegedly fired a gun toward three responding Omaha police officers. The officers immediately retreated to positions of cover in an effort to protect themselves while assessing the unfolding threat.

Police reported that the man then exited the residence and allegedly fired two additional rounds in the direction of the officers. In response to what authorities described as an immediate threat, one officer discharged their service weapon. The man fell inside the front doorway of the residence after being struck.

Following the shooting, additional officers, including members of the Omaha Police K9 Unit, moved in to secure the scene and ensure there were no additional threats. Emergency responders determined that the man had died at the scene. Investigators said a firearm was recovered next to him.

The deceased has been identified as David A. Asbury Jr., 44. The Omaha Police Department extended its condolences to the Asbury family, acknowledging the tragedy of the incident while emphasizing that the investigation remains ongoing.

As required under Nebraska law, the case will be presented to a grand jury after investigators complete their work. Nebraska Revised Statute 29-1401 mandates that a grand jury be convened whenever a person dies while in the custody of, or while being apprehended by, law enforcement officers.

The department also stated it will follow the procedures established under Nebraska Revised Statute 29-1407.01 regarding the release of investigative materials. If the grand jury returns a “no true bill,” evidentiary exhibits—including body-worn camera footage and transcripts from the proceedings—will become available for public review upon written request submitted to the Clerk of the District Court, in accordance with state law.

The investigation remains active as detectives continue reviewing physical evidence, officer statements, witness accounts, forensic findings, and other investigative materials. Officials have not released additional information regarding the responding officers or any further details about the events leading up to the encounter.

Authorities have indicated that more information may be released as the investigation progresses and the legal review process moves forward. Until then, the Omaha Police Department continues to ask the public to rely on official updates while investigators work to establish a complete and accurate account of the incident.
